Terms and Conditions of Use

Welcome to Nauti Test Pro (from here on, "the Platform"), available at nautitestpro.com. By creating an account or using any service of the Platform, you accept these Terms and Conditions ("T&C"). If you do not agree, do not use the Platform.
1. Who is responsible for the service
The Platform is operated by Juan Pablo Valenzuela Castro, with address in Guasave, Sinaloa, México (from here on, "the Operator").
2. Description of the service
Nauti Test Pro is a digital educational platform (PWA) that offers a question bank and mock exams for seafarers: the certificates of competency of the STCW Convention (IMO) —whose competence tables are the same wherever the certificate is issued—, the Marlins maritime English test, and the national syllabuses of Mexico, Argentina, Chile, Spain and El Salvador. The Platform is available internationally. Access to the content works through a system of practice tokens.
3. Eligibility
The Platform is intended exclusively for persons over 18 years of age. By registering, you confirm that you are of legal age. The Operator reserves the right to suspend accounts that do not meet this requirement.
4. User account
4.1 You are responsible for keeping your password confidential and for all activity that takes place under your account.
4.2 You must provide true and up-to-date information when you register.
4.3 You may not share your account with third parties or create multiple accounts to obtain free benefits fraudulently.
4.4 You must notify the Operator immediately of any unauthorised use of your account, at hello@nautitestpro.com.
5. Token system
5.1 Tokens are units of digital credit that give access to individual tests and evaluation sets within the Platform.
5.2 Tokens are bought with a one-off payment or obtained through the free bonuses the Platform offers at any given time: the verification bonus, which requires verifying both your email and your phone; the sign-up bonuses available in certain markets; and the reward for sending a review of the Platform. Each bonus is granted once per person, and its current conditions are shown on the Platform.
5.3 Tokens have no monetary value, are not electronic money and cannot be transferred to third parties, except through the Crew Plans expressly offered on the Platform.
5.4 Tokens do not expire while the account is active.
5.5 The Operator reserves the right to change the cost in tokens of each service, giving at least 15 days' notice.
6. Payments
6.1 Payments are processed through Stripe, Inc., an external provider. The Operator does not store bank card data.
6.2 Prices are stated in the currency of the market in which you registered: Mexican pesos (MXN) in Mexico, euros (EUR) in Spain, Chilean pesos (CLP) in Chile and US dollars (USD) in Argentina, El Salvador and the international market. They include the applicable taxes that Stripe determines for your country at the time of payment. The current prices of each market are published at nautitestpro.com/pricing.

7. Prohibited conduct
The following is expressly prohibited:
- Reproducing, distributing, selling or publishing the content of the Platform (questions, answers, evaluations) without the written authorisation of the Operator.
- Using automated tools (bots, scrapers) to extract content.
- Attempting to breach the security of the Platform or to access the data of other users.
- Using the account for activities that are unlawful or contrary to the applicable legislation, both Mexican law and the law of your country of residence.
- Reverse engineering the software of the Platform.
8. Intellectual property
8.1 Platform and code. The source code, visual design, logos, user interface, token system and structure of the Platform are the property of the Operator and are protected by the Mexican Federal Copyright Law (Ley Federal del Derecho de Autor). Access to the Platform does not give the user any right over those elements.
8.2 Content of the question bank. The bank does not have a single origin:
- Own work. The banks written by the Operator to reproduce the format and the skills of an exam, without copying its questions. This is the case of the Marlins maritime English bank, including its audio recordings and its explanations.
- Public exam sittings. The questions officially published by an administration together with its answer key, reproduced citing the sitting and the year — such as the PER exams published by Andalucía and the Comunidad Valenciana (2024–2026) and by the DGMM (2020).
- Own work aligned to the syllabus. Questions written by the Operator following the subjects and competences of an official syllabus, without reproducing the exam. This is the case of the banks aligned to the DIRECTEMAR series and to the STCW syllabuses.
Nauti Test Pro is an independent study tool, with no affiliation with, or official endorsement from, any educational institution, nautical school or government body. The trademarks and names of exams and certificates that appear on the Platform belong to their respective owners and are used only to identify the exam being prepared.
If you believe that any content infringes rights that you hold, write to us at hello@nautitestpro.com stating the specific content and your relationship to those rights: we will review it and, where appropriate, remove it.
8.3 Compilation. The selection, organisation, categorisation by chapters and presentation of the question bank constitute a compilation work under article 5 of the Federal Copyright Law, and it is protected as such. Reproducing, distributing or commercialising that compilation without the written authorisation of the Operator is prohibited.
9. Limitation of liability
9.1 The Platform is an educational preparation tool. The Operator does not guarantee that using the Platform will result in passing the official exam.
9.2 The Operator is not liable for interruptions of the service caused by maintenance, technical failures of third parties (Firebase, Stripe, etc.) or force majeure.
9.3 In no case will the total liability of the Operator exceed the amount paid by the user in the last 30 days.
10. Account termination
10.1 The user may request the deletion of their account at any time. Unused tokens will be lost with no right to a refund.
10.2 The Operator may suspend or delete accounts that breach these T&C, with no liability for unused tokens.
11. Changes to the T&C
The Operator may change these T&C at any time. Changes will be notified at least 15 days in advance by email or by a notice on the Platform. Continued use of the Platform after that period implies acceptance of the changes.
12. Applicable law and jurisdiction
These T&C are governed by the laws in force in the United Mexican States, and for any dispute the parties submit to the jurisdiction of the courts of Guasave, Sinaloa, México.
The above does not deprive a user who is a consumer of the protection given by the mandatory rules of their country of habitual residence, nor of their right to go to the courts of that country when the applicable law gives them that right. This is the case, among others, of consumers resident in the European Union (Regulation (EU) 1215/2012 and Regulation (EC) 593/2008).

Complies with the Mexican Federal Law on the Protection of Personal Data Held by Private Parties (Ley Federal de Protección de Datos Personales en Posesión de los Particulares, LFPDPPP) and its Regulations.
1. Identity and address of the Controller
Juan Pablo Valenzuela Castro (from here on, "the Controller"), with address in Guasave, Sinaloa, México, is responsible for the processing of your personal data collected through the Nauti Test Pro platform, available at nautitestpro.com.

2. Personal data we collect
For the purposes described in this Notice, we collect the following categories of data:

We do not collect sensitive personal data as defined in article 3, section VI of the LFPDPPP.
3. Purposes of the processing
Primary purposes (necessary for the service):
- Creating and managing your user account.
- Authenticating your identity and protecting access to the Platform.
- Processing payments and crediting tokens to your account.
- Sending transactional communications: email verification, payment receipts, password recovery.
- Providing technical support and handling user requests.
- Complying with legal obligations and preventing fraud.
Secondary purposes (you may object, see ARCO Rights):
- Sending push notifications with practice reminders (requires your explicit consent when you turn notifications on).
- Statistical analysis of the use of the Platform through Google Analytics (anonymised and aggregated data).
4. Data processors and transfers of data
To fulfil the purposes stated above, your data is processed by the following providers, which act as data processors on behalf of the Controller and under its instructions:

These communications of data, including international ones, are made under mechanisms that guarantee an adequate level of protection, including Standard Contractual Clauses and the applicable privacy frameworks. No transfers are made for commercial purposes to third parties not mentioned here.
5. Retention period
Your data will be kept while your account is active. When you delete your account, your personal data is deleted from our systems within a reasonable period, except for data that must be kept because of a legal obligation (transaction records, for example).
6. ARCO Rights
You have the right to Access, Rectify, Cancel or Object to the processing of your personal data (ARCO Rights), as well as to withdraw your consent and to limit the use or disclosure of your data.

Your request must include:
- Full name and the email address registered on the Platform.
- A clear description of the right you wish to exercise.
- A copy of an official identity document to prove your identity.
We will reply within 20 business days of receiving your request, in accordance with article 32 of the LFPDPPP.
7. Use of cookies and similar technologies
The Platform uses local storage (localStorage) to keep your session and your language preferences. If Google Analytics is enabled, it may use third-party cookies for statistical analysis of aggregated usage. You can disable cookies in your browser settings.
8. Changes to the Privacy Notice
The Controller may update this Notice at any time. Changes will be notified by a notice on the Platform or by email. Continued use of the Platform after changes are published implies acceptance of the updated Notice.
9. Users in the European Economic Area (GDPR)
If you live in the European Union, the United Kingdom or the European Economic Area, the processing of your data is also governed by Regulation (EU) 2016/679 (GDPR). The data controller is Juan Pablo Valenzuela Castro (contact details in section 1).
Legal bases. We process your data in order to: perform the contract you accept when you register and buy tokens (art. 6.1.b) — account, exam progress and payments; comply with legal obligations, such as keeping transaction records (art. 6.1.c); and pursue our legitimate interest in keeping the Platform secure and preventing abuse of the free bonuses (art. 6.1.f). Push notifications and commercial communications are sent only with your consent (art. 6.1.a), which you can withdraw at any time from the app menu or by unsubscribing.
Your rights. You can exercise the rights of access, rectification, erasure, restriction of processing, portability and objection (arts. 15 to 22), and withdraw your consent without affecting the lawfulness of the earlier processing. Write to hello@nautitestpro.com; we will reply within the period of one month set by art. 12.3.
International transfers. The Platform relies on providers established in the United States —Google (Firebase: authentication, database, storage and notifications), Stripe (payments), Resend (transactional email) and Sentry (error logging)—, so your data is transferred outside the EEA. Those transfers are covered by the Standard Contractual Clauses approved by the European Commission, which those providers include in their data processing terms.
Published reviews. If you publish a review, your first name, your country and the text become public on the Platform. You can ask for it to be removed at any time through the same email address. Please note that the public pages are served as static files generated on each deployment: the review stops being shown in the application immediately, and disappears from the static version on the next deployment, within 7 calendar days of your request.
Complaints. You can lodge a complaint with the supervisory authority of your country of residence; in Spain, the Spanish Data Protection Agency (Agencia Española de Protección de Datos) (www.aepd.es).
10. Supervisory authority in Mexico
If you believe that your right to data protection has been violated, you can file a complaint with the National Institute for Transparency, Access to Information and Personal Data Protection (Instituto Nacional de Transparencia, Acceso a la Información y Protección de Datos Personales, INAI), at www.inai.org.mx.
Refund and Cancellation Policy

This policy applies to all token purchases made on Nauti Test Pro (nautitestpro.com), operated by Juan Pablo Valenzuela Castro.
1. Nature of the service and digital goods
The tokens bought on Nauti Test Pro are digital goods with immediate access. In accordance with the Mexican Federal Consumer Protection Law (Ley Federal de Protección al Consumidor, LFPC) and the commercial practices applicable to digital goods, the purchase of tokens is final and irreversible once they have been credited to your account.
2. General policy: non-refundable
Tokens are not refundable for any reason, including:
- A change of mind after the purchase.
- Not having used the tokens bought.
- A request to delete the account while tokens are available.
- Not passing the official exam.
3. Exception: technical error or incorrect charge
A full refund will be processed only in the following cases:
- Duplicate charge: If more than one charge was made for the same transaction.
- Incorrect charge: If the amount charged is different from the price published on the Platform at the time of purchase.
- Tokens not credited: If you completed the payment and the tokens did not appear in your account within the following 24 hours.
To request a refund for a technical error, you must contact us within 7 business days of the charge, at:

Include: the email address of your account, the date of the charge, the amount, and evidence of the problem (screenshot).
We will review your request and reply within a maximum of 5 business days. Approved refunds are processed through Stripe to the original payment method within 5–10 banking business days.
4. Crew Plans (group plans)
4.1 In the Crew Plans, the buyer is solely responsible for entering the email addresses of the beneficiaries correctly before confirming the payment.
4.2 No refunds or adjustments will be made for email addresses entered incorrectly or for beneficiaries who do not use the tokens they received.
4.3 Group tokens are subject to the same non-refund conditions described in this policy.
5. Account cancellation
You can delete your account at any time. Deleting the account does not give a right to a refund of the available unused tokens.
6. OXXO payments
Payments made with an OXXO voucher are processed by Stripe and are valid for 3 calendar days. Once the voucher has expired without the payment being made at the store, the transaction is cancelled automatically and no charge is made.
